Job Purpose

To manage and protect the intellectual property portfolio for assigned technologies and products by driving patent filings, prosecution, infringement risk assessment, and competitor monitoring, while providing IP advisory support to product development and business teams.

To drive and safeguard the organization’s intellectual property interests by managing the patent portfolio for assigned technologies and products, providing strategic patent and infringement advice to product development teams, drafting and prosecuting patent applications, conducting IP investigations and due diligence, and supporting the business through IP risk mitigation, competitor monitoring, contract review, and stakeholder training.

 

Key Responsibilities

  • Manage global patent portfolio for assigned technologies and products.
  • Carry out patent investigations, state of the art searches, freedom to operate studies, patent landscape studies and prepare patent opinions.
  • Advise Product Development on patent infringement issues, design around options and patentability of proposed designs.
  • Police an assigned portion of the patent portfolio of the division.
  • Review products for patentable ideas. 
  • Review and evaluate invention disclosures. 
  • Draft and prosecute patent applications and represent the company before the India Patent Office. 
  • Review patents and patent activities of competitors, as well as monitor competitors' machines for possible infringements of the CNH Industrial patent portfolio.
  • Coordinate appropriate action to remedy infringing activities by competitors or other third parties.
  • Monitor company activities to prevent Intellectual Property infringement. 
  • Monitor outside counsel when required.
  • Draft, review and negotiate IP related contracts, joint development agreements, licenses, supplier agreements, non-disclosure agreements, scholarship agreements, co-development with universities, field test agreements and Memoranda of Understanding. 
  • Provide IP training to CNH Industrial personnel, including Engineering, Purchasing, Sales and Marketing.
  • Carry out patent due diligence and patent asset valuations.

Experience Required

  • Must have at least 4 years of professional Intellectual Property experience in India.
  • Having successfully taken the test at the Indian Patent Office (CGPDTM) to become a Patent Agent.
  • Excellent communication and computer skills (MS Office, Patent Management software).
  • Very strong English language skills (written and oral) are essential.
  • Ability to work under moderate supervision

Preferred Qualifications

  • Higher education (Bachelor equivalent) in Mechanical or Electrical Engineering.
  • A Master degree in Mechanical or Electrical Engineering is a material positive factor.
  • A Higher education (a Juris Doctorate (J.D.) equivalent) from accredited law school is a material positive factor. 
  • Experience managing international patent prosecution (e.g., U.S., Europe, and China) is a material positive factor.
